Miranda & Amado partner launches arbitration book with the University of Cambridge

Our partner José Daniel Amado, together with Jackson Shaw Kern and Martin Doe Rodriguez, launched the book “Arbitrating the Conduct of International Investors”, last February 16th at the Peace Palace in The Hague.

The publication, the aim of which is to serve as an comprehensive guide for the reform of international investment law, was very well received by critics during the presentation ceremony, which was attended by renowned lawyers and featured a panel composed of Eduardo Silva Romero, Cherie Blair QC, and Judge Koffi Kumelio A. Afande.

The event was also attended by Hugo Siblesz, general secretary of the Permanent Court of Arbitration, who praised the neutral posture of the authors, as well as the proposals for the restoration of “mutual access” in international investment arbitration and the defining of the rights of host states and their citizens in arbitration disputes at the international level. The authors expressed their agreement with these observations, maintaining that the aim of the work was to provide a level playing field for investors and states with regard to the resolving of disputes, thereby encouraging more responsible investment.

For his part, Jose Daniel Amado, a partner with the firm Miranda & Amado, reflected on the need to focus investment arbitration upon the investments, by opening them up to the different claims that might arise, as well as upon the international arbitration process as the ideal medium for resolving such claims. With regard to the proposals contained in the book, he expressed his wish that the models presented might help to move forward those investments which are currently shelved due to social conflicts.

In addition, both Silva Romero and Blair agreed that the arbitration community owed it to public opinion to speak in a language that encouraged reciprocity. Also, Afande highlighted the need to reestablish access to justice for all participants in international investment.

It should be noted that the prologue to the book, which is available through the University of Cambridge, was written by the renowned internationalist and expert in arbitration law, David Caron, former dean of Kings’ College London, who died recently.
